Past Pastiche Terms and Conditions

These Terms and Conditions form the basis on which you can visit our web site. Please read them carefully as they contain important information.

Definitions

Buyer

The person who buys or agrees to buy the goods from the Seller.

Conditions

The terms and conditions of sale as set out in this document and any special terms and conditions agreed in writing by the seller.

Goods

The articles which the buyer agrees to buy from the Seller.

Price

Price of the goods excluding any insurance import/export or duty costs.

1. General Terms and conditions

1.1 This site is owned and operated by Past Pastiche. If you have any queries about these terms and conditions or if you have any comments or complaints on or about our web site, you can contact us at yvonne@pastpastiche.co.uk.
1.2 These conditions shall form the basis of the contract between the Seller and the Buyer in relation to the sale of goods, to the exclusion of all other terms and conditions including the Buyers standard conditions of purchase or any other conditions which the buyer may purport to apply under any purchase order or confirmation of order or any other document.
1.3 All orders for goods shall be deemed to be an offer by the Buyer to purchase goods from the Seller pursuant to these conditions.
1.4 Acceptance of delivery of the goods shall be deemed to be conclusive evidence of the Buyers acceptance of these conditions.
1.5 These conditions may not be varied except by the written agreement of Yvonne Carter of Past Pastiche, the Seller.
1.6 These conditions represent the whole of the agreement between the Seller and the Buyer. They supersede any other conditions previously issued.

2. The Contract between us

We must receive payment of the whole price, including shipping costs for the goods that you order before your order can be accepted. Our acceptance of your order brings into existence a legally binding contract between us.

3. Ownership of rights

All rights, including copyright, in this web site are owned by or licensed to Past Pastiche. Any use of this web site or its contents, including copying or storing it or them in whole or part, other than for your own personal, non commercial use, is prohibited without our permission. You may not modify, distribute or repost anything on this web site for any purpose.

4. Accuracy of content

We have taken care in the preparation of the content of this website, in particular to ensure that prices quoted are correct at time of publishing and that all goods have been fairly described. Any weights, dimensions or sizes given about the goods are approximate only.

5. Damage to your computer

We try to ensure that this website is free from viruses or defects. However, we cannot guarantee that your use of this website or any websites accessible through it will not cause damage to your computer. It is your responsibility to ensure that the right equipment is available to use the website. We will not be liable to any person for any loss or damage which may arise to computer equipment as a result of using this website.

6. Availability

All orders are subject to acceptance and availability. If the goods you have ordered are not available from stock, we will contact you by e-mail or phone (if you have given us correct contact details). You will have the option either to wait until a similar item is available from stock or to cancel your order.

7. Ordering errors

You are able to correct errors on your order up to the point on which you click on “Pay Now” during the ordering process.

8. Payment terms

We will charge your credit card or Papal account for payment upon receipt of your order. We accept no liability if a delivery is delayed because you did not give us the correct payment details. If it is not possible to obtain full payment for goods from your account then we can cancel the contract and or suspend any further deliveries to you. This does not affect other rights we may have.

9. Delivery charges

Delivery charges vary according to the goods ordered and cannot be refunded.

10. Delivery

10.1 Our delivery charges are set out in the Shipping/Postage and Packaging section
10.2 Goods will be delivered to the address you specify for delivery in your order. It is important that this address is accurate. You, the Buyer will make all arrangements necessary to take delivery of the goods.
10.3 We cannot accept any liability for any loss or damage to the goods once they have been delivered in accordance with your delivery instructions. We will aim to deliver the goods by the date quoted for delivery but delivery times are not guaranteed.
10.4 We shall not be liable to the buyer for any loss or damage whether arising directly or indirectly from late delivery or, short delivery of the goods. If short delivery does take place, the buyers undertake not to reject the goods but to accept the goods delivered as part performance of the contract.
10.5 If the Buyer fails to take delivery of the goods on the agreed delivery date or, if no specific date has been agreed, when the goods are ready for despatch, the Seller shall be entitled to store and insure the goods and to charge the Buyer the reasonable costs of doing so.

11. Risk and ownership

Risk of damage to or loss of the goods passes to you at the time of delivery to you, or if you fail to take delivery at the agreed time, the time when we tried to deliver. You will only own the goods when we have received cleared payment in full.

12. Acceptance of the goods

12.1 The Buyer shall be deemed to have accepted the goods 48 hours after delivery to the Buyer.
12.2 The Buyer shall inform Past Pastiche within three days, in writing of any request to return goods.
12.3 Where the Buyer has accepted, or has been deemed to have accepted, the goods the Buyer shall not be entitled to reject goods which are not in accordance with the contract.

13. Cancellation by us

13.1 We reserve the right to cancel the contract between us if:
13.1.1 We have insufficient stock to deliver the goods you have ordered.
13.1.2 One or more of the goods you ordered was listed at an incorrect price due to a typographical error.

14. Liability

14.1 If you do not receive goods ordered by you within 30 days of the date on which you ordered them, we will have no liability to you unless you notify us in writing at our contact address of the problem within 60 days of the date on which you ordered the goods. If you notify a problem to us under this condition, our only obligation will be at your option:
14.1.1 To make good any shortage or non delivery;
14.1.2 To refund to you the amount paid by you for the goods in question in whatever way we choose.
14.2 Both parties shall only be liable under this contract for losses, which are a reasonably foreseeable consequence of the relevant breach of contract.
14.3 You, the Buyer must comply and observe with all applicable regulations and legislation, including obtaining all necessary customs, import, export or other permits to purchase goods from our site. The importation or exportation of certain of our goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the goods you purchase.

15. Changes to legal notices

We reserve the right to change these terms and conditions from time to time and you should look through them as often as possible.

16. Law, jurisdiction and language

This website, any content contained therein and any contract bought into being as a result of usage of this website are governed by and construed in accordance with English law. Parties to any such contract agree to submit to the exclusive jurisdiction of the courts of England and Wales. All contracts are concluded in English.

17. Invalidity

If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.

18. Privacy

You acknowledge and agree to be bound by the terms of our privacy policy.

19. Third party rights

Nothing in this Agreement is intended to, nor shall it confer any rights on a third party.

20. Refunds

Some of the goods on our website are not eligible for refunds. These items have this clearly stated in their description.
All of our goods are checked carefully. Cleaned or laundered before being offered for sale. They leave us in as good condition as is possible allowing for the nature of their vintage age. Please read each items description carefully.
20.1 Refunds will only be given on the purchase price. Not on shipping/postage and packing costs.
20.2 Due to the nature of Vintage, Antique and pre used items we endeavour to give a true and honest description of our goods. However, it is the Buyers responsibility to check sizing and condition of the items as stated on our website. Refunds will not be given on the grounds of poor fit.
20.3 If a Buyer wishes to request a refund they must do so in writing within three days of receipt of the goods being delivered. Goods must not be returned to Past Pastiche unless the Buyer has written consent from Past Pastiche to do so. In this instance return shipping cost will be at the Buyers expense and will not be refunded by Past Pastiche. Goods returned to Past Pastiche without written consent will not receive refunds under any circumstances.
20.4 Refunds will only be given when goods are returned and received by Past Pastiche in the condition that they were sent. With all labels/tags still attached, unworn/unused/clean and in the Past Pastiche packaging. Some of our goods, although vintage are new/unused and in the original packaging of the era that they were made. If this is broken, open, or damaged by the Buyer no refund will be given.
20.5 All goods returned to Past Pastiche must be sent using a reputable, insured carrier. Proof of dispatch must be obtained and retained by the Buyer.

21. Bespoke services

Only after written agreement from Past Pastiche will items be accepted for this service. Please contact us for more information and a quotation before you send items to us.
21.1 Payment for this service must be made before any work is being undertaken.
21.2 Items accepted for this service and work undertaken are at the Buyers risk. No responsibility for weak fabric, flaws or imperfection will by accepted by Past Pastiche. However, should Past Pastiche be of the opinion that an item once received, is not suitable for this service the Buyer will be informed. Return shipping/postage and packaging will be at the Buyers cost.
